Atómico 3 S.A. denounced a smear campaign in San Juan, Argentina, targeting its mining tokenization model

Key Points

  • The company is considering legal action for defamation and warned of the enforceability of Article 245 of the Argentine Penal Code.

  • Atómico 3 defends its regulated and transparent approach as a threat to traditional players in the mining sector.

Atómico 3 S.A., operating in Paraguay and Argentina, has denounced a disinformation campaign aimed at discrediting its pioneering model for regulated tokenization of real-world mining assets in Latin America.

The company pointed to a series of local media publications in San Juan, Argentina, which it claims contain "injurious, distorted, and false information" aimed at damaging its institutional legitimacy, proprietary technology, and corporate identity.

Atómico 3 stated that these publications not only reflect a serious failure in responsible journalism but may also constitute criminal offenses under Argentine law, including misuse of its registered trademark, manipulation of verified data, and false association with fraudulent activity.

“To those who defame, we remind you: Article 245 of the Penal Code is in force,” the statement reads, referring to the Argentine law penalizing false accusations and fictitious reports.

The company confirmed it is evaluating legal actions against the authors, promoters, and disseminators of the accusations and urged anyone with real evidence to present it in court.

“Everything else is defamation, manipulation, and media cowardice,” it stated.

A Digital Transparency Backlash?

Atómico 3 framed the incident as part of a broader offensive led by entrenched sectors of the mining industry, which the company says have historically monopolized access to capital, power, and mineral resources, limiting the development of small and medium-sized enterprises.

Positioning itself as a disruptive alternative, the firm promotes a new paradigm for the mining sector, built on traceability technology, decentralized financing, certified reserves, and financial inclusion, all within a clear regulatory framework.

Atómico 3 emphasized that it is the only model in Latin America to have voluntarily complied with the requirements of Argentina’s National Securities Commission (CNV) under General Resolution 1058/2025 for Virtual Asset Service Providers (PSAV), underscoring its transparency and legitimacy.

"Lithium Is Not a Black Box"

In closing, the company highlighted the strategic importance of lithium and other mineral resources, advocating for economic sovereignty through more open, auditable, and participatory models.

“Lithium is not a black box. It’s a strategic right. The sovereignty of the future is built with courage, technology, and determination, and that is our signature.”

The conflict reveals growing tensions in Latin America's mining sector, where blockchain and asset tokenization technologies are increasingly challenging traditional extractive power structures. As Atómico 3 moves forward with its legal and communications strategy, the case may mark a turning point in the clash between classical extractivism and decentralized innovation.
